Guidelines for Affiliate Training Centers

Section 1 Introduction & Applicability
These Terms and Conditions govern the relationship between Mokena Skills Private Limited ("Mokena Skills") and all authorized training entities, partners, or franchisees recognized as an Affiliate Training Center (ATC).
By maintaining an active affiliation status, utilizing our central portal, or enrolling students under Mokena Skills programs, the ATC signifies its irrevocable acceptance of these terms. These rules apply to all past, present, and future enrollments handled by the ATC.
Section 2 Absolute Restriction on Certification & Documentation
Zero Tolerance Policy on Self-Issued Certificates
The ATC has absolutely no authority to design, print, generate, or distribute any certificate, mark sheet, diploma, or letter of completion using the name, logo, or likeness of Mokena Skills Private Limited, NSDC, or Skill India.
- Centralized Issuance Only: All official credentials are generated, verified, and dispatched exclusively by the Mokena Skills Head Office and Authorized Assessment Agencies.
- Strict Ban on Logo Usage on Local Certificates: The ATC is strictly prohibited from affixing the logos of NSDC (National Skill Development Corporation), Skill India, or Mokena Skills on any self-generated, local, or unauthorized private certificates.
- Any locally printed or digitally forged certificate issued by the ATC bearing any of these logos will be treated as a severe act of fraud, leading to immediate blacklisting, center sealing, and formal legal prosecution for trademark infringement and forgery.
Section 3 Assessment Agency Mandate
Mokena Skills operates under a strict assessment framework validated by authorized third-party agencies. The ATC cannot act as both the trainer and the autonomous examiner.
- The ATC must adhere completely to the examination schedules, proctoring guidelines, and invigilation rules set by our Authorized Assessment Agency.
- Internal center-level tests cannot be used as the basis for issuing official Mokena Skills credentials.
- The ATC is required to provide necessary IT infrastructure (computers, webcams, internet) for smooth online assessments if mandated by the agency.
Section 4 Brand Name & Logo Usage (Mokena, NSDC & Skill India)
Brand identity is protected by law. The ATC must strictly follow the guidelines below regarding the usage of Mokena Skills, NSDC, and Skill India logos.
NSDC & Skill India Logo Guidelines
Mokena Skills does not grant any ATC the authority to use the NSDC or Skill India logos on our behalf for credentialing, official validation, or institutional representation.
- Permitted Use (Advertisements Only): The NSDC and Skill India logos may be used strictly for advertisement and promotional purposes (e.g., flex banners, flyers, social media ads) to indicate alignment with skill development initiatives, provided they comply with standard government usage guidelines.
- Prohibited Use (Documentation): You cannot print, stamp, or digitally embed the NSDC or Skill India logo on any self-issued certificates, ID cards, admission forms, or letterheads.
Unauthorized Mokena Branding
The ATC cannot use the Mokena Skills logo as their primary business identity. It cannot be used on local fee receipts, personal visiting cards, or standalone websites without prior head office approval.
Authorized Mokena Branding
The phrase "Authorized Training Center of Mokena Skills" can be used on promotional materials only after obtaining explicit written permission and design approval from the Mokena Skills Head Office.
Section 5 Mandatory Admission Protocol
Transparency in student enrollment is the cornerstone of our affiliation network. The prescribed admission procedure must not be bypassed under any circumstances.
- Every student must be registered on the official Mokena Skills portal within the stipulated timeframe after joining the ATC.
- Manual, offline, or "backdated" admissions maintained solely in the ATC's physical registers hold no validity. Mokena Skills takes no responsibility for students not reflected in the central database.
- The ATC is solely responsible for verifying the authenticity of a student's KYC documents (Aadhaar, prior mark sheets) before uploading them to the portal.
Section 6 Ban on Third-Party Routing
The ATC is strictly prohibited from utilizing the Mokena Skills brand name or associated government logos to attract students, only to route their admissions, assessments, or certifications through external private entities, rival agencies, or unauthorized third-party organizations.
Any evidence of cross-certifying candidates will result in immediate termination of affiliation and potential financial penalties for brand dilution.
Section 7 Infrastructure & Quality Standards
Mokena Skills is committed to delivering quality education. Therefore, the ATC must maintain predefined operational standards:
- Facilities: Adequate seating, ventilation, clean drinking water, and functional washrooms must be available for all trainees.
- Labs & Equipment: For technical or computer courses, a fully functional lab with the required software/hardware ratio as per the syllabus must be maintained.
- Trainers: The ATC must employ qualified and competent instructors for all offered courses.
Section 8 Financial Compliance
All financial transactions regarding affiliations, assessment fees, or portal charges must be conducted purely through official bank channels.
- Affiliation fees, renewal charges, and assessment fees are non-refundable under any circumstances.
- The ATC is responsible for managing its own local taxation, utility bills, and staff salaries. Mokena Skills holds no liability for the internal financial operations of the ATC.
Section 9 Data Privacy & Security
In compliance with applicable data protection laws, the ATC acts as a data fiduciary for the students they enroll.
The ATC must not sell, share, or misuse student contact details, KYC documents, or academic records for any external marketing purposes. Student data uploaded to the Mokena Skills portal must be handled with strict confidentiality.
Section 10 Audits & Inspections
Mokena Skills reserves the right to conduct unannounced physical inspections or digital audits of the ATC. This is to ensure compliance with infrastructure guidelines, admission records, logo usage policies, and quality standards. The ATC management is expected to fully cooperate with the inspecting officers.
Section 11 Breach & Termination
Mokena Skills reserves the right to immediately terminate the affiliation of any center without prior notice if they are found guilty of:
- Issuing fake or direct certificates bearing any unauthorized logos (Mokena, NSDC, Skill India).
- Misrepresenting the Mokena Skills brand or acting beyond the granted authority.
- Engaging in fraudulent admission practices or third-party routing.
- Failing to maintain the required educational quality and infrastructure.
Upon termination, the center's portal access will be revoked, and legal action may be initiated to recover damages caused to the brand's reputation.
Section 12 Governing Law & Jurisdiction
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of India. Any legal disputes, claims, or controversies arising between the ATC and Mokena Skills Private Limited shall be subject to the exclusive jurisdiction of the competent courts located in Kota, Rajasthan.
Acknowledgment of Terms
By submitting an affiliation request or continuing to operate as an ATC, you acknowledge that you have read, understood, and agreed to be bound by all the terms and conditions stated on this page, including strict adherence to the logo usage and certification policies.
